General Data Protection Regulation

WHAT IS GDPR?

GDPR is one of the most frequently mentioned terms today. GDPR stands for General Data Protection Regulation, which is the regulation of the European Parliament and Council (EU) 2016/679 on the protection of natural persons in relation to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation) (hereinafter referred to as the “Regulation”). The Regulation, as defined in the previous sentence, and GDPR are therefore one and the same.

 

WHO IS THE DATA CONTROLLER?

In relation to the products and services of NAM system, a.s., it is important to know who is the so-called data controller in relation to the personal data that NAM system, a.s. acquires through collaboration with you (i.e., by using our services and products). According to the Regulation, the data controller is the one who determines the purposes and means of processing personal data. More information can be found in:

WHEN ARE YOU THE DATA CONTROLLER?

In the case of most personal data, you are the data controller because you decided to provide personal data to NAM system, a.s. To help you fulfill your obligations, we have prepared a set of general information and also more detailed documentation for our individual products according to the Regulation.

WHEN IS NAM SYSTEM, A.S. THE DATA CONTROLLER?

There are cases when NAM system, a.s. is the data controller under the Regulation. This applies to personal data identifying you as a party to the contract or customer of NAM system, a.s., your contact, billing, payment, and delivery details, information about goods and services provided, and your payment history. In relation to this data, NAM system, a.s. is the data controller. How the company handles and protects this personal data is described here:

NOTICE

All documents provided are based on the state of legislation and interpretative opinions known at the time of their publication (May 2018). Some important legal regulations in this area are only in draft form (ePrivacy Regulation, new Czech law on personal data protection). These may bring new obligations or, conversely, ease existing ones. Similarly, interpretative opinions are subject to constant refinement and changes. This is a living and relatively complicated system. Despite all efforts for accuracy and correctness, future developments may show that some documents need to be revised. Legal regulations are general and there are many ways to comply with them, all of which can be correct. Please do not feel that just because GDPR is implemented differently elsewhere or through other procedures and documents, you are doing it wrong. GDPR, with few exceptions, does not specify processes for implementation – how to compile data, describe processing, conduct risk analysis, etc. It is important not to fall into the trap of doing nothing. In the event of an inspection by the authorities, inaction will be penalized most severely.
